US judge rules UnitedHealth 'secret' nursing home payments true

A Delaware superior court judge has thrown out a defamation lawsuit brought by UnitedHealth Group against the Guardian. Judge Calvin Scott dismissed all six claims on Monday, ruling in favor of the news outlet over its investigation into the insurer's financial arrangements with care facilities.

The lawsuit, filed in May 2025, targeted both the Guardian US and its UK parent company. UnitedHealth had pursued the legal action to challenge reporting that detailed how it secretly paid nursing homes to reduce hospital transfers for their residents. Scott firmly rejected the company’s arguments, stating the article’s characterization of the payments as “secret” or made “secretly” or “quietly” was “substantially true.”

UnitedHealth operates as the largest health insurance conglomerate in the US. For markets and investors monitoring the healthcare sector, a judicial confirmation that the company utilized undisclosed financial incentives to alter patient care pathways elevates the credibility of the original reporting. The court's formal validation of these payment practices places a spotlight on the specific cost-control mechanisms employed by a major industry player.

The court also directly addressed UnitedHealth’s complaints that the Guardian’s article had omitted favorable details about the payments. Scott wrote that the outlet “is not required to publish facts just because United would have preferred more favorable facts.” He concluded that “the omissions do not render the statements false.”

Guardian US general counsel Kai Falkenberg welcomed the decision as a decisive victory for press freedom. “We are delighted that Judge Scott has granted all of the Guardian’s motions to dismiss UnitedHealth’s lawsuit on the merits, a resounding victory for factual reporting and the first amendment,” she said.

Falkenberg further criticized the legal strategy employed by the healthcare conglomerate. “Even after UnitedHealth’s lawsuit was filed, the Guardian did not back down, continuing to publish new detail in our investigation. [Monday’s] decision is a vindication of the Guardian’s deeply sourced, independent reporting, and a rejection of UnitedHealth’s bullying and intimidation tactics.”

UnitedHealth had not issued a public statement responding to the ruling as of Tuesday morning. The company retains the right to appeal the dismissal, and the Guardian has stated it approached the insurer for comment.
